摘要 1994年,《国家赔偿法》的颁布被誉为“对宪法承诺的公民基本权利的兑现”.十三年后,我国有关国家赔偿特别是精神损害赔偿缺位的讨论再次升温,成为一个热点问题.在受到国家行政机关 ,司法机关及其工作人员以国家名义作出的违法行为侵害时 ,不给受害人精神损失补偿的做法是不公正的.虽然法院依法作出的判决并不违背现行法律 ,立法上的残缺必将导致执法上的狭隘.时代的进步,社会的发展,进一步呼唤对国家侵权的精神损害作出金钱或物质赔偿问题作出明确规定.

Abstract In 1994,the "State Compensation Law" enacted as the "commitment to the Constitution of the fundamental rights of citizens of honor." After thirteen years,my compensation for the countries concerned in particular the lack of compensation for moral damage the discussion once again heating up,becoming a hot issue.By the state administrative organs,judicial organs and their staff the name of the state law infringed upon,not compensation for mental anguish to the victims of the practice is unfair.Although the judgments of the Court in accordance with the law is not contrary to existing law,the legislature is bound to lead to the incomplete enforcement of the narrow-minded.The progress of the times and social development,and further calls for the spirit of the state tort damage to money or material to make clear that the issue of compensation.State compensation for moral damage Key legislative proposals
